Quietly, in the spring of 2026, the rules of selling to the Welsh public sector changed. The main duties of the Social Partnership and Public Procurement (Wales) Act 2023 came into force on 25 March 2026, and the annual reporting duty followed on 1 April 2026. If you bid for Welsh public work — construction especially — this affects you directly.
What changed
Welsh contracting authorities — Welsh Ministers, local authorities, NHS bodies and other devolved public bodies — must now carry out procurement in a way that improves economic, social, environmental and cultural well-being. In practice, each authority must:
- Set and publish socially responsible procurement objectives, and keep them under review;
- Publish an annual procurement strategy and maintain a public contracts register;
- Publish an annual socially responsible procurement report — the first reports cover 2026/27 and are due from April 2027;
- For major construction contracts (£2m+): take reasonable steps to include social and workforce clauses, ensure they're implemented — and ensure they flow down into subcontracts.

Why this matters if you're a contractor
Every Welsh public body now has to measure and publicly report the social value its procurement delivers. They can only report what their suppliers can evidence. That pressure lands on you in three places:
- At tender — social value commitments are scored, and a bid that evidences delivered social value beats a bid that promises it;
- During the contract — on £2m+ construction work, the new clauses mean your delivery against social commitments is monitored, not filed away;
- Down the chain — flow-down means subcontractors will increasingly be asked for the same evidence by main contractors.
The contractors who do well out of this will be the ones holding a running, costed record of what they already deliver — the school visits, the apprenticeships, the careers talks, the community projects — rather than scrambling to reconstruct it at bid time or year end.
